农民工是中国农村剩余劳动力的主体,保障农民工权益成为农村剩余劳动力能否成功转移的一个关键问题。农民工是弱势群体,由于保障制度缺失其权益屡被侵犯,又因维权成本高,使其无力维护自身权益,以至于一些农民工采取过激方式维权。本文以交易成本理论为基础对农民工权益受侵害的原因进行分析。人力资本的专用性体现在由雇主出资进行简单就业技能培训这一农民工就业的主要模式中,这种模式使掌握生产环节单一技能的农民工过于依赖雇主的雇用;有限理性的存在使农民工对损害自己利益的行为不能做出迅速反应;机会主义行为使雇主一方用微妙和隐藏的手段去侵犯农民工权益;大量剩余劳动力面对雇用市场上小数目的雇主的这种典型劳动力买方市场的特征使农民工成为规则的接受者,在劳动关系谈判中完全处于被动地位。经过上述分析,本文从制度视角提出保障农民工权益的对策。首先,要积极发展农民工非政府组织,它提供了解决农民工问题的新模式,即非政府非营利模式。要为发展农民工非政府组织提供跨地区的交流,在培养管理干部,提供资金等各方面给予支持。其次,要改革城市政策偏向,在以户籍制度为核心的各项制度上给予农民工平等的待遇。再次,要健全劳动力市场体系,加强劳动市场监察,规范用工单位的用工行为。最后,建立素质教育与职业技能并重的农民工培训体系。
